An Offensive Defense
Often Gleason & Associates is hired to conduct a financial analysis to support litigation that has already commenced. But in this case, outside counsel for a multinational Fortune 100 firm contracted us to conduct an analysis in an attempt to avoid litigation.
Gleason was hired to analyze the client's exposure in a contract dispute with a small, privately held company. The small company, which developed a formula for a consumer product that our client had licensed, contended that by failing to aggressively market the product, our client was unfairly limiting the small company's royalties.
We evaluated the strengths and weaknesses of the small company's claims and assessed our client's risk and potential damages.
Knowing the potential damages up-front equipped counsel and the client to negotiate intelligently.
By outsourcing the financial analysis, the client obtained an impartial opinion while avoiding internal conflicts of interest.
Because the analysis was conducted before it was necessary to mount a legal defense, objectivity was ensured.
